Mississippi state rules
- Water and wastewater submetering is allowed in Mississippi under Miss. Code 77-3-97 for apartment houses with four or more units, manufactured home communities, and condominiums
- Ratio (RUBS) billing is not allowed in Mississippi; Miss. Code 77-3-97 authorizes billing for actual submetered usage, so NES bills residents for their own measured use
- Owners must disclose submetered billing to each resident and obtain a written acknowledgment, and submeters must meet American Water Works Association accuracy standards
- A resident's charge cannot exceed their pro rata share of the water and wastewater used at the property, and service cannot be disconnected for nonpayment of a submetered bill
- Electric and gas submetering are not allowed in Mississippi, so those utilities stay billed by the serving utility, and owners cannot add an administrative fee to the submetered water bill
- Under a 2026 Mississippi law (HB 1404), a landlord who collects utility payments from residents and knowingly fails to pay the utility commits a crime, and NES pays the master-meter bill for you
